We have hired Richard Kanoff of Burns & Levinson in Boston to represent the membership of Protect Sudbury, Inc. Richard is a well-renowned attorney in the utility and utility siting arena. He has extensive experience representing both utilities and community groups like ours and has appeared before the Energy Facility Siting Board. Incidentally, Richard was also the lead attorney for many Massachusetts and New Hampshire municipalities and community groups in the Kinder Morgan gas pipeline fight. We were encouraged to learn that the Kinder Morgan fight has proven successful and this multibillion dollar project has just been halted.

On our behalf, Richard has been busy interviewing experts who will help us challenge every technical assumption in the Eversource proposal. Richard has hired our first technical experts to explore the viability of alternatives to the Eversource proposal. Richard has also filed a Public Records Request with Hudson Power and Light (“HP&L”) to explore the relationship between HP&L and Eversource as it relates to the genesis of the Eversource proposal. This has yielded some interesting documents that we will continue to explore.

We have formed a legal working group comprised of local legal professionals who have volunteered their time to help develop some promising additional legal theories to oppose the Eversource proposal. We also continue to work closely with our Research group to funnel the fruits of their labor to our attorney, particularly as it relates to viable alternatives to the Eversource proposal. We are optimistic about the legal challenges that continue to take shape. Pursuing these additional theories will add to our legal expenses so we desperately need your help to fund this important work.

As always, we will continue to keep you updated on our legal battle through this newsletter and other media.
